Terms of service

These terms are the agreement between you and VPNmine covering the VPNmine apps for Windows, macOS, Android, iOS, Android TV and Apple TV, the browser extensions for Chrome, Edge, Opera and Firefox, the VPN network behind them, and this website. Installing or using VPNmine means you accept them. They also serve as the end user licence agreement required by the app stores.

Eligibility

You must be at least 13 years old, or 16 in the EEA and the UK, and old enough to enter a contract where you live. If you use VPNmine for an organisation, you confirm you are authorised to accept these terms on its behalf.

The service

VPNmine routes your traffic through servers we operate, using OpenVPN on the desktop, mobile and TV clients and an encrypted proxy in the browser extensions. The service is currently free and ad free. A paid tier may be introduced later, and we will announce it in the app before anyone is charged.

A VPN conceals your traffic from your local network and your internet provider. It does not make you anonymous to the services you sign in to, does not defeat every form of tracking, and does not change what is legal where you are.

Your account

You can connect without an account. If you create one, keep your credentials to yourself and tell us at support@vpnmine.com if you think someone else has access. You are responsible for activity under your account. You can delete it at any time from Settings in any app or on the account deletion page.

Acceptable use

Do not use VPNmine to:

• Break the law where you are, or where the server you connect through is hosted.
• Send spam or bulk unsolicited messages.
• Scan ports, probe, attack, overload or attempt to gain unauthorised access to any system.
• Distribute malware, run botnet command and control, or host phishing.
• Share, distribute or access material that sexually exploits children.
• Harass, threaten, defame or stalk anyone.
• Infringe copyright or other intellectual property rights.
• Resell, sublicense or rebrand access to the network.
• Circumvent our rate limits, run automation that degrades the service for others, or operate a service on top of ours without written permission.

We may suspend or terminate accounts and devices that do these things. Because we keep no record of browsing activity, enforcement is based on abuse reports we receive and on the connection metadata described in the privacy policy.

Availability

We work to keep the network up but do not guarantee uninterrupted or error-free service. Servers may be added, moved or retired, capacity may be limited, and maintenance may interrupt connections. Nothing here is a service level commitment.

Payments and subscriptions

There is nothing to pay today. If and when a paid tier launches, the following applies.

• Subscriptions are sold and billed through Google Play or the App Store, not by us directly. Payment is charged to your Google or Apple account at confirmation of purchase.
• Subscriptions renew automatically for the same period at the then current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You manage and cancel subscriptions in your Google Play or Apple account settings, not in the VPNmine app. Cancelling stops the next renewal and does not shorten the period you have already paid for.
• Refunds follow the policy of the store you bought through. Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial.
• Prices, plans and features may change with notice for future periods.

Terms for Apple platforms

The following applies to the iOS, iPadOS, macOS and tvOS apps obtained from Apple, and is required by Apple. In these clauses "the App" means the VPNmine application for an Apple platform.

• Parties. This agreement is between you and VPNmine only, and not with Apple. VPNmine alone is responsible for the App and its content.
• Licence. You are granted a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support. VPNmine is solely responsible for providing maintenance and support. Apple has no obligation to furnish any.
• Warranty. VPNmine is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims. VPNmine, not Apple, is responsible for addressing any claim by you or a third party relating to the App or your use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• Intellectual property. If a third party claims the App infringes its intellectual property rights, VPNmine, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms when using the App.
• Third-party beneficiary.Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, have the right to enforce it against you.

Terms for Google Play and other stores

Where you obtain VPNmine from Google Play, the Chrome Web Store, Microsoft Edge Add-ons, Opera addons or addons.mozilla.org, that store is not a party to this agreement and is not responsible for the app. The store's own terms also apply to your download and to any purchase you make through it.

Open source components

The VPNmine apps include third-party open source software, including OpenVPN and its platform clients. Licence notices are listed in the app under Settings, and are available from support@vpnmine.comon request. Where a component's licence requires us to make corresponding source available, we will do so on request.

Our intellectual property

The VPNmine name, logo, apps and website are ours or our licensors'. Aside from the licence to use the apps described here, nothing in these terms transfers any right in them to you.

Disclaimers

Except where the law says otherwise, VPNmine is provided as is and as available, without warranties of any kind, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service will meet your requirements, that it will be uninterrupted, or that it will make you anonymous.

Limitation of liability

To the extent the law allows, VPNmine is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of the service. Where liability cannot lawfully be excluded it is limited to the greater of the amount you paid us in the twelve months before the claim, or ten US dollars. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every right your local law gives you.

Indemnity

You agree to indemnify VPNmine against claims, damages and reasonable costs arising from your breach of these terms or your unlawful use of the service. This does not apply where the law prevents it, and it does not apply to consumers acting outside a trade or profession where local law says otherwise.

Export control and sanctions

VPNmine includes encryption and is subject to export control and sanctions law. You may not use it in breach of those rules, and you confirm you are not subject to sanctions that would prohibit your use.

Termination

You can stop using VPNmine and delete your account at any time. We may suspend or terminate access if you breach these terms, if we are required to by law, or if we discontinue the service. Where we discontinue a paid service you have already paid for, we will provide a pro rata refund through the store you bought it from.

Changes

We may update these terms. The date at the top always reflects the current version. Material changes are announced in the app before they take effect, and continuing to use VPNmine after that means you accept them.

Governing law

These terms are governed by the law of [governing law jurisdiction, to be completed before launch], and the courts there have jurisdiction. If you are a consumer, you may also bring proceedings in the country where you live, and you keep the protection of that country's mandatory consumer law.
